Terms and Conditions (1) Introduction Welcome to Insta Deal, this is the usage policy and the terms and conditions of the application and your use of it and all its items and services. By agreeing to the Terms and Conditions and the relevant information contained in this Agreement and using the Application, you are hereby bound by these Terms and Conditions (insta deal). Your use of insta deal means that you agree to activate the User Agreement, and if you do not agree to the User Agreement, please do not enter, register or use this application. Before you become or continue to be a member with us, you must read and agree to the User Agreement and Privacy Policy (insta deal) and enter to any other related information regarding the User Agreement, such as any applicable use policy-related information, all such information and privacy policy are applied under this law in the User Agreement. (2) Membership Eligibility In insta deal, we want to make sure that all members are able to form legal binding contracts and that minors do not use the application the application in an inappropriate manner for some goods and products of purchase through application, therefore, the application will ask you to specify your age group as 18 years or more when purchasing some goods and products available on the application. In case of damage to insta deal rights and laws, insta deal reserves the right to terminate or exclude the membership of any person who violates the foregoing. On the other hand, in case of signing in the application as a commercial entity or legal entity, you  confirm that you can subject this entity to the user agreement and that you and the business entity are subject to all applicable laws related to online trading. (3) Commitments to your own account and registration in the application. When you are registered as a member of the application, you must provide certain information and register your user name and your secret number (password). When you become a member of the application you agree to the following: A-You are responsible for maintaining the privacy and restriction of the use of your account and your password. B- You declare that you are fully responsible for the activities that occur through your account and your password, and that you will inform (insta deal) for any illegal use of your password, private account or security violation. C- Insta deal will not be liable for any direct or indirect loss of profit or damage to the goods due to the disclosure of your user name and / or your password. D-You cannot use someone else's account without showing the account holder's permission. E-Your membership means your consent to indemnify insta deal for any illegal use of your account through you or anyone else's access to the application and services by using your username and password whether or not you are aware of such use. F- You provide us correct, accurate, right, current and complete information about you as required in the registration form (registration data) of insta deal. G- Do not place the word "insta deal" in your user name. H- You maintain and update the data required at the time of registration to remain accurate, current and complete, and in case of incorrect, inaccurate or incomplete information or if we suspect that this information is untrue, inaccurate, incomplete, not sufficient, or inconsistent with the User Agreement and is not subject to the terms and conditions of insta deal, it has the right to stop, terminate, close your account in the application and / or your membership of the application. I- insta deal (at its option and at any time) has the right to make any inquiry it deems important (directly or through an intermediate) and to ask you to give it information or other evidence without any restrictions to ensure your identity and / or ownership of your financial covenants, and without limitation to the user. In the event that the user is a commercial entity, such information and evidence must contain your commercial license or other files or evidences that show members of the entity or the entitlement of any person in the entity to act on your account and you agree to give (insta deal) any information or proofs upon request, and if you refuse to give the above, insta deal may restrict, suspend or close your application and / or membership account and also refuses to complete your sale and purchase process, and we reserve the right to terminate any inactive or not activated account for a long period of time. (4) Electronic Communication By completing your registration, you agree that we can contact you by e-mail or by sending notices to the application or its associated websites and you agree to all agreements, notices, statements or other communications that we can provide to you electronically so as to meet the legal requirements, and insta deal will request to obtain your consent during the registration process to send promotional messages that allow you to know any new change, feature or any promotional activities added to the app or its associated website, if you wish at any time to stop the promotional messages you receive, you can choose to do so by clicking on the link below any promotional message. (5) Amendments to the User Agreement By completing your membership, you agree that insta deal may modify the user agreement to increase your obligations or reduce your rights (substantive modification) in accordance with the rules of the user agreement. You agree that insta deal (at its option and at any time) without any responsibility may make material amendment that is clarified on the application itself or its website. (6) Expenses and Services Because insta deal is an electronic shopping application, not an auction, and does not do any kind of those activities, instead it is an electronic platform that allows the sale and purchase of products between sellers and buyers. Membership is free and there are no additional fees to browse the app or its websites. Insta deal can make a temporary change to its services for offers or promotions (such as delivery days and free shipping) or providing new services for a specified period. These temporary changes are deemed to be effective under their terms when they are published on the application, its website or various means of publication. All expenses shall be paid in Kuwaiti Dinar or in the currency of the buyer's country. All expenses and taxes shall be paid to insta deal within (7) days from the date of issue of the invoice by any method of payment possible and permitted as stated in the fees and balance policy. (7) Your Information By using insta deal you give us the right to use any personal or other information or data that you give to us or to other users and / or registered on the website at the time of registration or at the time of sale in the area of ​​opinion or through any e-mail or by any feature in the application in order to improve and manage the application or its websites in accordance with the User Agreement and Privacy Policy. (8) Use of application or its associated websites By agreeing to the terms and conditions, you confirm the accuracy and correctness of the information and details provided by you (in addition to the registration information), depending on the time and place. You shall be bound when using the app or its websites with the following: 1- The application is not used in any way that causes, or is likely to cause, to impair, access, damage or disable it. 2- Not to use the application in any criminal activity, theft or illegal activity or any activity that would harm any third party. We have the right to suspend, restrict or block your use of the Application at any time and without notice in case we have reasonable evidence that you have breached any of these restrictions or in the event that we suspect that your account is engaged in illegal activities. This does not prevent us from taking any other action towards you as we see fit. (9) Property rights The content of the application and its websites completely and for example but not limited to, texts, designs, logos, icons, buttons, photos,  audio content, digital content, data collection and software are subject to the property rights and copyrights of insta deal, its users, content providers or licensors as they are protected by Trademark, marks, patent or other intellectual property. The entire content of this application or any websites is proprietary and copyrighted and is protected by copyright, trademark, marks or patent rights or any other intellectual property rights. (10) Trademarks Insta deal and any associated logos, words or slogans in the application or any of its websites are either registered or unregistered trademarks and are protected by international trademark and other intellectual property rights and laws. The trademarks of insta deal in any product or service that does not belong to insta deal and in no way is detrimental to insta deal, and all other non-insta deal trademarks that appear on the application or any website site belong to their original owners, who are likely or unlikely to be associated with or related to insta deal. (11) Abuse (of insta deal) Please report any problems of any kind or violations of these Terms of Use through insta deal. If you believe that your intellectual property rights have been violated, please inform insta deal, and without prejudice to any other rights or measures of insta deal, Insta deal may limit, suspend or block the entry of any user of the application or any of its affiliates and / or members and may also delete any user-added content. In addition to that (insta deal) may take any technical and / or legal action against any person who causes legal problems or violations of any kind to infringe the intellectual property rights of any third party or conduct any action contrary to these Terms of Use or our policy. (12) Consumer Protection Insta Deal has a Consumer Protection Program designed to help consumers protect their purchases from fraud. If the consumer purchases a product with any of insta deal payment methods and the product does not receive or receive a much lower value product than insta deal, the consumer can take protection measures under the consumer protection program. The consumer protection program includes the return of the product value only to the consumer through insta deal and in order to be eligible for protection in the Consumer Protection Program, the consumer must complete the complaint form within 48 hours (from receipt or non-receipt) of the product. (if it is the only reference) that the seller intentionally misrepresented the consumer with respect to the product compensated to the consumer by the insta deal, insta deal may suspend, limit or obscure The seller may enter the site and / or its membership on the site and may insta deal at the cost of the seller to return the goods to the consumer whether the product or shipping expenses (according to Payment and expenses.) Second: A new order for the required product (s) is performed as an alternative to the recovered product. B) If the consumer submits the complaint two days after the date of delivery: (only if the refund is approved), the consumer pays the freight and delivery charges 2) Product returns due to consumer error (product in original condition when purchasing and receiving) A) In this case insta deal does not accept recovery or replacement for health or other reasons. B) According to the Kuwaiti law, which provides for return, the return policy for the defectless product allows the buyer to return the product by going directly to the supplier's shop within 14 days from the date of purchase accompanied by the invoice.   (13) Communication platform In particular: (insta deal) is not responsible for any late or unsatisfactory performance, loss or damage resulting from the unavailability of the product. A) insta deal does not provide any warranties of any features (including but not limited to the quality, value, and affordability) of the products planned for sale or purchase through the application or any affiliated site, and does not implicitly support, express or endorse Buy or sell any product in particular through the application, and insta deal is not a product or a manufacturer of any product sold or purchased by users. B) insta deal does not provide any warranties of features (including but not limited to non-compliance with the law or financial entitlement or identity) of its employees. C) Users must agree to the terms and conditions of delivery, payment and insurance between each other independent and does not incur any liability towards these agreements. D) insta deal is not responsible for any error or negligence by any third party. E) insta deal disclaims all warranties, conditions and implied warranties and assumes no liability for any material loss or effect on reputation or any consequential or indirect consequences arising out of your use of or inability to use the Application or any other website. (14) Privacy Insta deal may take some reasonable measures (physical, regulatory, technological) to protect against unauthorized access to your personally identifiable information and to ensure that it is also secure, although the Internet is not a secure medium and the privacy of your personal information cannot be guaranteed. Third party practices (such as a site that displays the link to this application or any third party site or a third party impersonating yourself or someone else), you agree that insta deal can use your personal information to provide services and send you advertising content Privacy of the site is governed with the handling, use and transfer of any personal information of your own. (15) Breach of Terms of Use Without prejudice to any of the rights or procedures (of insta deal) under this User Agreement or under any law or otherwise, insta deal has the right immediately and without any legal liability to limit your activity, limit or cancel your membership and / or you will be blocked from accessing the application or any site related to it in the following cases: A) If you violate this User Agreement. B) If insta deal is unable to verify or ensure any information provided by you. C) If insta deal believes in its sole discretion that any of your actions may lead to legal accountability against you or against other users or against insta deal. D) Insta deal shall have the right, at any time, as it deems appropriate, to stop the suspension of previously suspended accounts of the outstanding users. The user who is excluded or suspended from membership at any time may not attempt to register or use insta deal in any way until insta deal stops the suspension of his account. Notwithstanding the foregoing, if you breach these Terms, Conditions or Terms of Use, insta deal has the right to recover any amounts owed by you or to be compensated for any loss or damage caused to insta deal and is entitled to take similar steps including appropriate judicial and / or criminal proceedings as appropriate and if insta deal fails to take any action against any violations by you or from any other person, this does not imply a waiver of insta deal of its right to take any action in respect of such violation or any other similar violations, and does not ensure that such actions are taken against all possible violations of these Terms of Use. (16) Blocking your access to application or any of its associated and / or your membership suspension Without prejudice to any of the rights or procedures (of insta deal) under this User Agreement or under any law or otherwise, insta deal has the right and without any liability to limit your activity, limit or cancel your membership and / or restrict your access to the application or any other website at any time without notice for any reason including, but not limited to, a violation of these Terms of Use. (17) There is no guarantee Insta Deal provides the application or any of its associated website and services on "as they are basis" and "as available" basis without representation or endorsement and without any warranties or guarantee of any kind, either express or implied, including, but not limited to, on title guarantees, Popularity and convenience for certain purposes, compatibility, safety and accuracy and non-infringement. Insta Deal does not provide any warranties or representations regarding the accuracy, reliability or completeness of any content, information, software, text, images, links or communications provided by the website or through its use or that the operations on the website will be free from errors and insta deal does not provide guarantees that the defects are fixed, that the application or any of its websites and services is free of viruses or anything else that may cause damage or loss. This application may be in accordance with the nature of the Internet communications subject to the destruction of its data or its suspension or not being available or delayed. This application or any associated website too may be unavailable from time to time and for fixing and maintenance purposes or for the purpose of works development. You agree that insta deal is not obligated to provide support for this application or its associated site, and you agree that you are using this application at your own responsibility. (18) Limits of Responsibilities To the extent permitted by law, insta deal, its officers, employees, agents, internet websites, its affiliates, and its respective suppliers shall not be liable for any losses or damages of any kind, whether direct, indirect, incidental, special, consequential, losses or damages resulting from loss of profits or reputation of the company, securities, data or other intangible losses arising out of or related to your use of the website, its services or the User Agreement (except those resulting from negligence and etc.) and whether insta deal has been advised to take responsibility or such losses and damages or not). If you are dissatisfied with the app, any associated website, its content, or its products, the only solution is to stop using it. Furthermore, you agree that any unauthorized use of the website or its services as a result of your complacency and for your failure may cause irreparable problems in insta deal and it will deal with any unauthorized similar use under the Terms and Conditions of these user terms. (19) Compensation You agree to indemnify and protect Insta Deal and its affiliates, officers, employees, agents and suppliers from damages arising out of any disputes, complaints, actions, losses, liabilities or frauds (including legal costs and expenses) of any kind arising from your violation of the Terms of Use Agreement or violation of any laws or third party rights. (20) Relationships and notices All of the terms and conditions mentioned in the User Terms Agreement do not constitute or form a partnership or an intermediary between you and insta deal. You have no right to bind insta deal to anything and in any way. (21) Disputes If there are any disputes or complaints (including damage or legislative complaints) (disputes) arising out of or in connection with this User Agreement, including (without limitation) any questions regarding information, entity, field, performance, interpretation or validity or termination of this Terms of Use Agreement or this section, or any questions related to the legal relations arising out of this User Terms Agreement or the effects of their invalidity, the parties shall attempt to resolve the dispute in the first instance peacefully within a maximum period of thirty (30) days starting from the date of sending a written notice to the other party. (22) Transfer of rights and obligations You hereby grant insta Deal the irrevocable right and declaration that Insta Deal may at any time transfer all or part of its rights, obligations, benefits or liabilities (whether express or presumed) under User Agreement to any associate, at any time and without previous written consent from you. Insta deal agrees to use all available endeavors to notify you of any transfer through publication on website. You may not at any time and without prior written consent from insta deal transfer all or part of your rights, obligations, benefits or liabilities (either expressed or assumed) under this Agreement to the user without prior written consent from (insta deal). (23) General Provisions If any provision of the User Agreement is found to be null or void or for any reason unenforceable, such as if the clause is subject to severalty, this shall not affect the performance and validity of the rest of the clauses in this document. This user agreement shall previously (and the amendments hereof from time to time) all clauses of understanding and agreement between you and insta deal, taking into account the relevant subjects. No person who is not a party to this User Terms Agreement shall have the right to impose any condition and if this User Agreement is translated into any other language, either on the application or any other associated website the Arabic text shall be considered the original reference. (24) Governing Law This User Agreement shall be governed by and construed in accordance with the laws of the State of Kuwait. This provision shall govern the expiration or termination of the User Agreement for any reason. The terms and conditions of this Application or any of its terms and conditions shall be governed by and construed in accordance with Kuwaiti law. In addition, the disputes resulted and related to these site conditions (including non-contractual disputes) shall be subject to exclusive jurisdiction of Kuwaiti courts. Disclaimer and confirmation of what is stated in clause (17) The information, content, products, services and materials available through the Application or any of its associated websites (whether provided through (insta deal) through you, or through other users or third parties / affiliates) including but not limited to food / beverage orders, presentations, text, photographs, graphics, audio files, videos and links, are provided "as they are" and are available without warranty of any kind, express or implied to the fullest extent permitted by law. Insta deal waive any warranties and representations, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, ownership, non-infringement, free from computer viruses, and implied warranties arising out of the context of the transaction or the performance context.
